Terms and Conditions
We at Empathycopy pride ourselves on our excellent products and service, but it’s a good idea for us to have terms and conditions so we all know what to expect. We believe agreements like this should be easy to understand, so we’ve made sure this one uses clear and simple language.
Having said that, if anything is unclear, ask. We’ll be happy to clarify.
Summary
Our generators help you create drafts of your website copy. In exchange for a fee, you'll be able to use the generators for unlimited single-practice use for the term of your purchase.
It's not ok to share access to the generators with other people and we reserve the right to cancel your service with us, without refund, if we see evidence of multiple practices using a single account.
It's also not ok to use the generators in a way that aims to understand the underlying formulas. We reserve the right to cancel your service with us, without refund, if we see evidence of theft of our approach or formulas.
You'll have the rights to use anything your generate but not use the results for resale.
What Do We Both Agree To Do?
As the customer, you agree:
- You have the power to agree to these terms for yourself or behalf of your organization.
- In addition to these terms, you also agree to our privacy policy - recognizing that we do collect data about you to provide our services.
As provider of our products and services, we agree:
- We have the experience and ability to perform the services we promise.
- We will respect the confidentiality of any information you give us.
- We will respond to any support needs to using our products or services in a timely manner.
We both agree:
- These Terms And Conditions and Privacy Policy, although written by Empathycopy, are agreed upon by both parties.
Your Account
When you purchase our services through our site, you must register for an “Account”. When you sign up for an account, you agree to provide true, accurate, and complete information in our registration form. You also agree to update and maintain your information’s truthfulness and completeness.
You also agree to grant access to your account only to users authorized to act on behalf of yourself and only in accordance with our Terms and Conditions of Service. You are fully responsible and liable for any action of any user who uses your account.
You will be asked to choose a username and password for your account and you agree that you will keep your login details safe and confidential.
Each Account Can Be Used For One Practice Only
By proceeding with your purchase of Empathycopy products or services, you agree that your account will be used for a single practice only.
For example, if you have a solo practice, you can use the generators for only the practitioner within the practice. If you have a group practice, the group practice user may use the generators for the entire practice.
However, you may not use the generators for more than one practice. This is what we mean when we refer to "single-practice use only", that these generators should be used for only one practice.
Each Account Cannot Be Used To Take Our Formulas
By proceeding with your purchase of Empathycopy products or services, you agree that the Empathycopy products or services will be used to create drafts of your website copy and not to steal, reveal, or capture the underlying formulas on which Empathycopy runs.
We Reserve The Right To Cancel Your Account Anytime
The information you put inside of the generators is confidential but we do monitor your use.
If we find reason to believe that you have shared account access with multiple practitioners, or you are using the generators to reveal or steal our approach or formulas, we will cancel your account immediately and you will not receive a refund.
Completing Generator Forms
Make sure you are happy with your responses in your forms before generating the copy. Reading the form questions completely and filling out the answers with some thought, will improve the quality of the results you get.
You may generate copy with the forms an unlimited number of times if you are unsatisfied with results the first time around.
We Ask That You Don’t Plagiarize
Empathycopy uses your own words to generate the copy.
If you insert plagiarized phrases, sentences, paragraphs, or other content into your form, Empathycopy is not responsible for that and you will indemnify Empathycopy of any suits or liabilities or damages drawn against you for the use of such copy.
Basically, don't steal stuff and put it in our forms. Our generators do not protect you against wrongful use of someone else's copy.
Copyright
When you generate copy, a license of the generated work is automatically assigned to you. You can then use the work for your marketing.
However, the results are not for resale. You do not get the right to use generated copy as a product that you sell or for inclusion in products that you sell.
For example, you cannot use our generators to create copy for a website that you create and sell as a product itself. If you would like to incorporate generated copy into a product or service for resale, please reach out to us to discuss an extended license.
If we provide you with further educational materials, guides, ebooks, tools, blog posts in our blog, or other resources, all such materials are copyright Empathycopy and may not be distributed, shared, copied, or published in any format.
Data Security
We care about the information that you give us, so much so that we have taken reasonable technical and procedural measures designed to keep your personal information from loss or unauthorized access, use, or disclosure.
However, we cannot guarantee that unauthorized users will never be able to break through our security and use your personal information for improper purposes. You acknowledge that you provide your personal information or who you represent at your own risk.
Save What You Generate - We Do Not Store Your Results Beyond Your Subscription Period
You are responsible for saving, storing, and backing up the copy that you generate. If you forget to save or store your copy or lose or misplace your copy, we are not responsible for re-generating your copy or for long term storage of your copy beyond your payment period.
Note: you only have access to your results during your subscription period. Please make sure you save your copy on your own computer before your subscription's expiration date.
That said, in some cases, we may not have cleared out our database and your results may still be within your account. If this is the case, you can reactivate your subscription to retrieve them. But we never promise to store your copy for you so recommend taking care to save, store, and back up any copy that you create.
No Refunds
This is a digitally based service and as such, it cannot be returned once you have purchased it.
Your continued access cannot be "returned" as a physical product might be so there are no refunds.
Things That Are Outside Of Our Scope
We love creating generators to help you on your path towards awesome copy for your website, but there are limits to what we provide. Please take note that at this time, the following are examples of services that are outside of the scope of what we do:
- We don't offer editing or revision services
- We don’t insert or format copy onto your website
- We don’t include training on where or how to insert your copy
- We don’t offer consultancy
- We don't offer interviews in-person or virtually
We Are Not Responsible For Your Inability Access Empathycopy
If you face any difficulty accessing Empathycopy that is that is beyond Empathycopy team's control, we are not responsible and we will not refund your purchase or extend your subscription.
Examples of difficulties you may face that are beyond our control:
- Your website browser of choice blocks you from inserting text into fields and you do not wish to use another browser or update your browser
- Your internet connection is slow and takes too long to load multi-page forms
- You are in a tornado and had to leave your computer behind for a few days
- Your iPad got damaged and you couldn't use it for a few days while it was getting repaired
If you believe that our site or technology is to blame for an access issue you face, we are happy to troubleshoot any issues you may face. (We're friendly and helpful so email us support@empathycopy.com with any issues and we often reply in 24 hours or less).
That said, sometimes work, life, and technology challenges do occur and many will be beyond what Empathycopy can control. We are not liable for things that we did not break, cannot fix, or other unfortunate events.
Legal Stuff
We do our best to ensure our work doesn’t infringe upon any copyright or other right of a third party.
However, we can't be liable to you, or any third party, for damages, including lost profits, lost savings, complaints, claims, litigation or other incidental, consequential or special damages which arise regarding our work.
You acknowledge that Empathycopy gives no warranties with our work and that you will indemnify Empathycopy against any loss or damage in cases where rights, releases, or consents have not been obtained.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
You cannot transfer these terms to anyone else without our permission. Our Terms and Conditions stays in place and need not be renewed.
We may update these Terms And Conditions so it is your responsibility to create a copy for your records.
Although the language is simple, the intentions are serious and our Terms and Conditions of Service, as outlined here, constitute a legal document under exclusive jurisdiction of United States courts.
Your Agreement
You agree to these terms when you purchase our services from us and are bound to these terms as exactly stated unless you have been given written amendments signed by us.
